The “omnibus decree” has once again been approved by the government, despite having been rejected by the Plenary of the Congress of Deputies. Pedro Sánchez, the Spanish Prime Minister, announced that the Council of Ministers has approved a new decree-law that will allow pensions to be reassessed, as well as transport allowances and delegates the suspension of evictions of tenants when rent is not being paid on time.

The text, published in the Official State Gazette (BOE), came into force on 30 January 2025 and must be ratified by the Chamber of Deputies within a maximum of 30 days.

The Prime Minister guarantees that the royal decree-law “contains almost everything” of the law that was rejected by the Congress of Representatives. Only a few outstanding measures remain, such as the extension of “Plan Moves III” aid or payments to autonomous communities, which will be approved in the coming weeks.

Suspension of evictions

As far as the suspension of evictions is concerned, it will be extended until 31 December 2025, thus completing five years of validity, to be applied in the same cases as before. This means that the authorities consider the households in situations of vulnerability, without housing alternatives subject to the 1994 LAU. Or cases of households living without a title, victims of gender violence, dependents or with dependents or dependent minors, and who are in a situation of social vulnerability.

Likewise, the possibility of claiming compensation from the owners if the Administration and public services fail to find an alternative housing will be extended until 31 January 2026, for which they have a three-month deadline.

To receive the support, the tenant must submit a request for deferment and the court is responsible for requesting a report from the municipal social services to prove their vulnerability. If no solution can be found, the landlord is entitled to compensation.
